In the name of God, Amen, I Malichi Joiner of the State of Georgia and County of Washington being of Sound and perfect mind and memory, blessed be God for the same, calling to mind the mortality of the body and knowing that it is appointed to all men once to die, do make and ordain this my last Will and testament and doing ?? that it may be received ?? as such

First and princepally I recommend my Soul to God who gave it and my body to the earth to be buried in a decent and Christian like manner, and the estate which it hath pleased the Almighty to bless me with in this life I give and dispose of as follows viz

Second I give and bequeath to my Son John Joiner one Dollar he having received his share of my Estate while living

Third - I give and bequeath to my Daughter Elmira Smith wife of Joseph Smith one Dollar, she having received her share of my estate while living

Fourth I give and bequeath to my son Jessee Joiner one tract of land lying on big Branch adjoining Squire William Young containing sixty five acres more or less to him and his heirs forever

Fifth I give and bequeath to my five children Jessee, Elias, Malichi Elizabeth and Rachel Sixteen head of cattle now at Daniel Lloyds and Hardy Hartleys together with their increase and twenty two head of Sheep with their increase (to be divided with my Wife and other children) portion to them and their heirs forever share and share alike

Sixth I give and bequeath to my beloved Wife Rachel during her widowhood the tract of land on which I now live containing three hundred acres more or less - three head of Horses twenty two head of cattle they being there at home with their increase thirty seven head of Hogs and increase twenty head of sheep, the increase of them to be divided with my children as in item fifth a yoke of steers and cart, all the geese and poultry, Household and Kitchen furniture and plantation tools of every description, all the corn fodder meat and grains that may be on hand together with the (next word not readable) crop at my death for the purpose of supporting her and my five children namely Joseph Martha Ann, William, Moses and Mary Ann and nursing ??? them up, should she marry again it is my request that my Executors take all the property in this item together with the children and support them on it until Moses becomes of age when the property may be divided amongst the said named children in this item share and share alike. Should my wife Rachel not intermarry the property to remain together until her death at which time it is to be distributed share and share alike to my said children Joseph Martha Ann William Moses and Mary Ann.

Lastly I nominate and appoint my son Elias Joiner and William Jackson my Executors to this my last Will and testament, hereby revoking all former Wills by me made

In witness whereas I have hereunto made my mark and affixed my seal this twenty first day of February in

the year of our Lord one thousand eight hundred and forty six.

In the name of God Amen I Malichi Joiner of the County and State aforesaid being in my sound mind and for the love I have for my children therefore I give and bequeath to my ten youngest children viz Elias Joiner, Malichi Joiner, Jesse Joiner, Elizabeth Bedgood, Rachel Boatwright, Joseph Joiner, Martha Avant, William Joiner, Moses Joiner and Mary Joiner my four Negroes viz Becky and her child Hannah Caty and child Martha. My wish is that the above named Negroes be sold by my Executors or administrators as the case may be. I give my son Elias two hundred and fifty Dollars first and an equal share of the balance with rest.

Hereunto I set my hand and affix my seal this the 2nd of March in the hear of our Lord eighteen Hundred & fifty four
